Getting Started with Mediation The very first step in getting started is to determine if mediation is the right process for you. Let’s face it – it takes two to reach a deal. If either you or your partner are not willing to or are simply not suitable candidates for mediation, then there is no point engaging in the process.

This is why our first step is always to help you come to an informed decision. Our initial meeting is at no charge to you and is simply to help us screen to ensure that mediation is an effective option for you.

    Understanding the Role of your Mediator

    The role of every mediator is to act as a facilitator for settlement. What this means is that we are not there to judge or to impose what we think is best for your situation. We are there as neutral third parties to ensure that you negotiate the best possible settlement for YOU. YOU is emphasized because you’re unique. Your desires and goals are unique to you. We design your mediation process so that it allows creative settlement of your disputes.

    The design process includes deciding whether you should meet together or separately (also known as caucus/shuttle mediation). You get to choose between in-person or online mediation, depending on what meets your needs considering factors such as work, childcare, ease and ability to travel, etc. As your mediators, we facilitate difficult conversations, but parties must always remain civil and respectful. Our mediation sessions are always closed. This means whatever is discussed at mediation will not be shared outside of that process. It is completely confidential.

    For example, your settlement discussions at mediation cannot be used against you in court by the other party. Mediation is a voluntary process. This accounts for most of its success because parties in mediation choose this dispute resolution process. It means we cannot force either party to do anything but for most people choosing mediation, they do not want to be forced to do anything. They appreciate the voluntary, confidential and cost-effective nature of mediation.

    At our mediation sessions, we help you understand your BATNA. given our strong background in the family law legal system. BATNA stands for your best alternative to a negotiated agreement. We remain neutral and focused on helping you reach a win-win settlement of your family law issues.
